MOD HOUSE RENOVATIONS, LLC – CONTRACT & TERMS OF SERVICE

1. Introduction
This Contract and Terms of Service (“Agreement”) is entered into by and between MOD House Renovations, LLC, a Florida Limited Liability Company, with its principal place of business at 15810 88th Pl N, Loxahatchee, FL 33470(“Company,” “we,” “us,” or “our”), and the undersigned client (“Client,” “you,” or “your”). By accepting our Quote, Proposal, or Estimate (“Quote”) or otherwise engaging MOD House Renovations, LLC for remodeling, renovation, or related services (“Services”), you agree to be bound by the following terms and conditions.
2. Description of Services
Reference to Accepted Quote via Jobber
The specific Services to be provided by MOD House Renovations, LLC shall be as detailed in the Accepted Quote, which is accessible at any time via the Jobber platform.
The Accepted Quote, including any descriptions, itemizations, and pricing, forms an integral part of this Agreement. In the event of any inconsistency between this Agreement and the Accepted Quote, the provisions in this Agreement shall control unless otherwise specified in writing.
Scope of Services
Any services not explicitly stated in the Accepted Quote will be considered outside the scope of work and may incur additional costs if requested.
MOD House Renovations, LLC will not commence any out-of-scope work without first obtaining the Client’s written or electronic approval of the revised cost and timeline.
3. Quotes, Pricing & Validity
Validity of Quotes
All Quotes provided by MOD House Renovations, LLC are valid for 60 days from the date of issue.
After 60 days, pricing and availability are subject to change.
Material Price Changes
Due to market fluctuations, material costs may change. If any material cost increases after the Quote is issued but before material purchase, we will notify you and provide an updated Quote.
You may proceed under the revised pricing or choose alternative materials as discussed and agreed upon in writing.
Unforeseen Circumstances
Should we discover hidden or previously unknown conditions (e.g., termites, mold, faulty plumbing/electrical, structural damage, water intrusion) that affect the project’s scope or cost, we will provide a Change Order with revised pricing and timelines.
Work on these additional items will only proceed upon the Client’s written or electronic approval.
4. Worksite Conditions & Client Responsibilities
Restricted Work Area
The designated project area must be kept clear of all furniture, personal belongings, or other items until the project is complete.
If you bring any items into the work area prior to completion, you assume all responsibility for any damage to those items and for any additional labor or materials required to complete the project or perform touch-ups.
Access & Utilities
The Client must provide safe and reasonable access to the property (including areas pertinent to the work) and ensure the availability of utilities (electricity, water, etc.) throughout the project.
Any delays or additional costs arising from restricted or unsafe access may be billed to the Client.
Site Clean-Up & Disposal
MOD House Renovations, LLC will maintain a reasonably clean and safe worksite.
Construction debris and waste will be disposed of in accordance with local regulations, with any standard disposal fees included in the Quote unless otherwise specified.
On-Site Conduct & Communication
To support the quality of our work and help keep your project on schedule, we ask that Clients allow our team—both crew members and the project manager—to work without unnecessary interruption. While we deeply value transparency and collaboration, frequent drop-ins, casual conversation, or ongoing oversight can disrupt momentum and divert attention from the details that matter most.
If you have a question or need to address something related to the project, your designated project manager is available to assist. We ask that communication be purposeful and focused on project-related matters to ensure efficient decision-making and to respect the time and responsibilities of everyone involved. This structure helps us stay aligned, meet key milestones, and deliver the caliber of work you’ve entrusted us with.
Client-Provided Materials
If the Client chooses to purchase and supply their own materials (e.g., fixtures, appliances), MOD House Renovations, LLC is not responsible for issues stemming from delays, damage, incompatibility, or product failures. These materials must be delivered on time and be suitable for the project. Any resulting timeline changes or labor adjustments will be reflected in updated invoices or schedules.
Design Services & Client Selections
By hiring MOD House Renovations, LLC, Clients are engaging us to perform renovation and construction services. Our core responsibility lies in the execution of that work—whether based on plans and selections provided by the Client, or in collaboration with a separate designer or architect. Unless design services have been contracted separately, Clients are solely responsible for making all design decisions related to the project.
This includes, but is not limited to:
Selection of fixtures, finishes, appliances, paint colors, tile, cabinetry, hardware, lighting, and layout preferences
Submission of accurate specifications and confirmation of product suitability for the space and scope of work
Timely procurement and delivery of selected items (if not handled by MOD House Renovations, LLC)
We understand that making these decisions can feel overwhelming, which is why we offer in-house design services for Clients who would like creative support and professional guidance throughout the selection process. If you are interested in adding design services to your project, we will provide a detailed scope of work and associated design fees for your review and approval.
Unless you have formally engaged MOD House Renovations, LLC for design work, our team will rely on the specifications, materials, and selections you provide. We will not be responsible for the aesthetic outcome, product compatibility, or the overall cohesiveness of the finished space when selections are made independently.
In either case, we remain committed to executing the work with precision, care, and attention to detail. Clear communication and timely decisions will help ensure a smooth experience from start to finish.
5. Photo & Video Release
Permission to Photograph/Video
By entering into this Agreement, you grant MOD House Renovations, LLC the right to photograph or video record the project areas before, during, and after work for marketing and promotional use (e.g., social media, website, digital advertising, printed materials).
We will not disclose your address or personal details, nor will we include identifiable images of homeowners without explicit consent.
Opt-Out
If you do not consent to photo or video usage, you must notify us in writing (email is acceptable) before work commences. We will honor your request and refrain from using any photos or videos for marketing or promotional purposes.
Provision of Photos/Video
We will provide copies of any relevant photos or videos upon request.
6. Payment Terms
Accepted Payment Methods & Surcharges
We accept cash, check, Zelle, bank ACH, and credit cards.
A 4% surcharge applies to all credit card payments.
A 1% processing fee applies to ACH payments.
Florida Sales Tax
Applicable Florida state sales tax will be added to materials and certain labor services as required by law. These taxes will be itemized clearly on each invoice.
Payment Schedule
Materials Deposit: To secure the job and initiate ordering of materials, the Client shall pay a deposit of 30% to 70% of the total estimated project cost (depending on scope and materials).
Labor Pre-Payment: Before labor commences, 10% of the total labor cost is due.
Ongoing Payments: Progress payments will be made weekly or bi-weekly, as agreed upon in writing.
Pre-Final Payment: 5% of the total project cost is due prior to completion.
Final Payment: The remaining 5% is due upon completion of the project.
7. Non-Payment & Resumption Fee
Work Halt & Overdue Payments
If a scheduled payment is not made on time, MOD House Renovations, LLC may halt work immediately until payment is received.
Any payment overdue by more than two (2) weeks will result in an additional resumption fee of $1,500, in addition to all outstanding amounts owed, before work can continue.
Legal Remedies
If you fail to pay all amounts due, MOD House Renovations, LLC reserves the right to pursue any and all legal remedies, including filing suit in the appropriate court.
In the event of legal action to collect any unpaid balances, you shall be liable for all associated legal fees, court costs, and any additional expenses incurred.
8. Changes, Cancellations & Restocking
Change Orders
Any Client-requested alterations to the scope of work, materials, or design after the project has begun will require a Change Order.
Additional costs for labor and/or materials will be reflected in a revised Quote or invoice, which must be approved by the Client in writing before work proceeds.
Material Returns & Restocking
If you decide to change or cancel materials that have already been purchased, you will be responsible for restocking fees, return shipping costs, and any associated administrative or labor expenses.
Cancellation or Termination
If you cancel the project after it has started, you will be liable for all costs incurred up to the point of cancellation, including materials, labor, restocking fees, and other direct expenses.
9. Client-Supplied Materials
We understand that some Clients may wish to purchase and provide their own fixtures, appliances, or other materials. While we can incorporate Client-supplied items into the project when possible, it’s important to be aware of the risks and responsibilities involved.
Clients are fully responsible for selecting appropriate products, ensuring they meet the necessary specifications for the project, and arranging for timely delivery to the job site. MOD House Renovations, LLC will not be held liable for any issues resulting from the use of these materials, including—but not limited to—delays, product damage, missing parts, incorrect sizing or configuration, or incompatibility with the existing space or systems.
We cannot guarantee the project timeline when Client-supplied materials are involved and will not assume responsibility for disruptions caused by their availability, condition, or performance. If the use of these materials results in downtime, rescheduling, or additional labor, such adjustments will be reflected in the updated schedule and may incur additional costs.
If you are considering supplying your own materials, we encourage you to do so with careful planning and a clear understanding of the implications on workflow and scheduling.
10. Design Services Engagement
Overview
For clients who want more than renovation execution—those seeking a cohesive, functional, and beautifully designed space—MOD House Renovations, LLC offers optional design services. These services can be customized to the level of support you need, whether you’re looking for guidance with a few selections or full-scale design planning.
What You Can Use MOD House Renovations, LLC For
When engaging our design services, Clients may choose from a range of support areas, including:
Concept Development: Establishing a clear design direction through mood boards, visual references, and overall style framework
Space Planning: Creating layouts that improve flow, function, and livability
Material & Finish Selection: Curating materials such as tile, flooring, cabinetry, countertops, paint, and trim
Lighting Design: Recommending fixtures and placement for layered, purposeful lighting
Plumbing Fixture Selection: Coordinating faucets, sinks, shower systems, and other fixtures for both form and function
Hardware Selection: Selecting finishes and profiles for cabinet and door hardware to support the design intent
Color Palette Development: Building a cohesive palette that flows consistently throughout the home
Furniture & Accessory Selection: Offering guidance on furnishings, rugs, artwork, and decorative accents
Custom Design Elements: Recommending or sketching bespoke features like built-ins, niches, or wall treatments
Style Consultations: Providing feedback and direction on Client-led selections to ensure overall cohesion
Design Process
Once design services are requested, MOD House Renovations, LLC will schedule an initial consultation to understand your aesthetic, functional goals, and project scope. From there, the process typically follows four phases:
Discovery & Visioning
We gather information on your needs, style preferences, and project goals
Review inspiration images, design pain points, and existing conditions
Concept Development
Creation of mood boards or other visual frameworks to set the tone and direction
Initial discussions around materials, layout concepts, and color story
Design Development
Refined selections of finishes, fixtures, and layout adjustments
Presentation of product links, reference imagery, or samples as applicable
Final Selections & Documentation
Compilation of a final selections list, design notes, and specifications for use during construction
Optional support sourcing or coordinating product procurement (if contracted)
The scope and depth of deliverables will reflect the service level selected by the Client. Clear communication and timely feedback are key to ensuring design progress aligns with the renovation timeline.
Design Fees & Structure
Design services are billed separately from renovation services. Fees may be structured as a flat rate or hourly, depending on the nature and extent of involvement. A design proposal outlining scope, deliverables, and pricing will be provided for Client approval. No design work will begin until the proposal is accepted in writing and initial payment is received.
Limitations
Unless explicitly included in the design proposal, the following services are not included:
Architectural or structural drafting
Permit documentation
3D renderings or photorealistic visuals
On-site installation supervision for furnishings
Procurement of materials or furnishings
Additional services may be available upon request and billed accordingly.
Ownership & Use
All design concepts, visuals, and documentation produced by MOD House Renovations, LLC remain the intellectual property of the company. Clients are granted a limited-use license to apply the approved designs to the contracted project only.
11. Estimated Timeline & Delays
Project Schedule
Any estimated start and completion dates are approximations provided in good faith.
Actual completion may vary due to factors such as weather, supply chain delays, change orders, or unforeseen conditions.
When Clients choose to furnish their own items, MOD House Renovations, LLC cannot guarantee the project timeline or accept responsibility for any delays or disruptions that may result.
12. Force Majeure
MOD House Renovations, LLC is not liable for delays or non-performance caused by events beyond our reasonable control, including but not limited to natural disasters, labor strikes, pandemics, governmental acts, or other force majeure events.
The obligations of the affected party shall be suspended to the extent necessary by such an event, and the affected party shall use reasonable efforts to resume performance once the event ceases.
If a force majeure event persists for an extended period, MOD House Renovations, LLC may terminate this Agreement without liability to the Client other than for Services performed and materials purchased up to the date of termination.
13. Final Walkthrough & Limited Warranty
Final Walkthrough
Upon substantial completion, MOD House Renovations, LLC will schedule a final walkthrough with the Client.
Any punch-list items or concerns identified during this walkthrough will be addressed promptly.
15-Day Notice Period
You have 15 days following the final walkthrough to report any issues related to the work performed.
Issues reported after this period may be subject to additional charges.
Manufacturer Warranties & Fixtures
Appliances, fixtures, and other products are covered under their respective manufacturer warranties.
Any labor required to repair or replace items under manufacturer warranties may be billed separately.
Workmanship Warranty
MOD House Renovations, LLC provides a limited workmanship warranty for a period of 1 year from the date of final project completion.
Coverage: This warranty covers defects in our workmanship under normal use and conditions. If a covered defect is found and reported within the warranty period, we will repair or replace the defective work at our discretion.
Exclusions: This warranty does not cover:
Damage or defects resulting from misuse, negligence, or abuse by the Client, occupants, or guests (e.g., scratching surfaces, hitting walls, spilling liquids that cause damage).
Normal wear and tear or cosmetic issues arising from ordinary use over time.
Damage caused by modifications or repairs performed by anyone other than MOD House Renovations, LLC.
Issues arising from environmental factors (e.g., moisture, mold, termite infestation post-completion, flooding, acts of God).
Any item or component covered under a separate manufacturer’s warranty (e.g., fixtures, appliances).
Voidance: If the Client or a third party modifies or repairs our work without our prior written approval, the workmanship warranty is void.
14. Concierge Maintenance Plan
Annual Maintenance Option
We offer an optional Concierge Maintenance Plan for ongoing support and upkeep.
The plan’s specifics (scope, frequency of visits, etc.) are customized per project and will be communicated in a separate document or addendum.
Opting In
Clients may opt in to the Concierge Maintenance Plan at project completion or at any time thereafter by notifying MOD House Renovations, LLC in writing or via email.
Upon receipt of your request, we will provide the relevant plan details, pricing, and an Agreement or addendum for your review and signature.
Maintenance Plan Payment
The maintenance plan fee can be paid in full annually or split into monthly payments, as agreed upon in writing.
15. Insurance & Liability
Insurance Coverage
MOD House Renovations, LLC carries general liability and, where required, workers’ compensation insurance. Proof of insurance can be provided upon request.
Liability Limitation
Our total liability for any claim arising out of or related to this Agreement shall not exceed the amount paid by the Client for the Services rendered.
Indemnification
To the extent permitted by law, the Client agrees to indemnify, defend, and hold harmless MOD House Renovations, LLC, its employees, subcontractors, and agents from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorney fees) arising out of the Client’s negligence, misuse of the worksite, or breach of this Agreement.
16. Mechanic’s Liens
Notice of Right to File Lien
Under Florida law (and other applicable laws), contractors and suppliers may have the right to file a mechanic’s lien on the property if they are not paid for Services or materials provided.
MOD House Renovations, LLC reserves the right to place a lien on the property in the event of non-payment for completed work or delivered materials.
17. Default
Events of Default
Failure to make any required payment when due.
Insolvency or bankruptcy of either party.
Failure by the Client to provide necessary access or resources that prevents MOD House Renovations, LLC from performing the Services in a timely and safe manner.
Any other material breach of this Agreement by either party.
Remedies
In the event of a default by the Client, MOD House Renovations, LLC may suspend or terminate this Agreement, pursue collection of any unpaid amounts, file suit, and seek any other legal remedies available.
The non-defaulting party shall be entitled to recover reasonable attorney fees, court costs, and any other expenses incurred in enforcing its rights under this Agreement.
18. Notices
Method of Notice
Any notice required or permitted under this Agreement shall be deemed sufficiently given if delivered personally, sent by certified mail (return receipt requested), or sent via email with proof of delivery, to the addresses identified in this Agreement or as otherwise provided in writing by the parties.
Effectiveness
Notices shall be effective upon receipt or the date of refusal of delivery.
19. Amendments & Waivers
Amendments
This Agreement may be modified or amended only by a written document signed (physically or electronically) by both the Client and an authorized representative of MOD House Renovations, LLC.
Waiver
The failure of either party to enforce any provision of this Agreement shall not be construed as a waiver or limitation of that party’s right to subsequently enforce and compel strict compliance with every provision of this Agreement.
20. Governing Law & Dispute Resolution
Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-law principles.
Dispute Resolution & Mediation
The parties agree to attempt in good faith to resolve any dispute arising from this Agreement through mediation before pursuing legal action.
If litigation becomes necessary, the prevailing party shall be entitled to recover reasonable attorney fees, court costs, and any other related expenses.
21. Severability
If any provision of this Agreement is deemed invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
If a court finds that any provision, though invalid as written, may be made valid by limitation, then such provision shall be deemed to be written, construed, and enforced as so limited.
22. Availability & After-Hours Communication
Hours of Availability
MOD House Renovations, LLC is available for communication via call and text as well as on-site work during the following hours:
Monday through Friday: 8:00 AM – 6:00 PM
Saturday: 10:00 AM – 2:00 PM
Closed on Sundays
We reserve Sundays and time outside of these hours for rest, family, and personal obligations. Protecting this space allows us to show up for each project with the clarity, focus, and attention it deserves.
After-Hours Communication
For non-urgent matters outside of business hours, please email us at modhousereno@gmail.com. We will respond the next business day.
If you are experiencing an urgent issue, you may call or text—but we ask that this be reserved for true emergencies only. For all other communication, email remains the best way to reach us and ensures your message is received, documented, and addressed in a timely and organized manner.
23. Entire Agreement
This Agreement, along with the Accepted Quote (accessible via Jobber), Change Orders, and any written addendums or proposals, constitutes the entire agreement between the parties and supersedes any prior or contemporaneous understandings or representations.
24. Acceptance
By approving a quote through Jobber or otherwise indicating written or electronic acceptance, you certify that you have read, understood, and agree to abide by all the terms and conditions set forth in this MOD House Renovations, LLC Contract & Terms of Service.
